General conditions

Article 1. General

The use of the websites and services of Huurscreen B.V. (hereinafter: Huurscreen) is subject to the following general conditions and restrictions. Accessing and using Huurscreen means that the user is deemed to have read these terms and conditions and restrictions and to have accepted them. If you do not wish to be bound by these terms and conditions, do not use or visit Huurscreen.

We reserve the right to modify and update these Terms and Conditions from time to time in our sole discretion ("Updated Terms and Conditions"). Unless we make changes for legal or administrative reasons, we will make reasonable efforts to notify you before the Updated Terms become effective. You agree that we will notify you of the Updated Terms by posting them on the Websites and that by continuing to use the Websites after the Effective Date of the Updated Terms (or by taking any action as reasonably directed by us) you agree to be bound by the Updated Terms. It is your responsibility to review these terms and conditions and any Updated Terms before using the Websites.

Article 2. Important definitions

In these terms and conditions, "you" refers to both you as an individual and the entity you represent.

"Object" the rental property registered on the Platform by the Recipient.

"Recipient" the broker, or landlord, or owner who posted the property on the Platform.

"Tenant" is an individual seeking to rent an Object from a Landlord. Under certain circumstances, as required for a normal rental transaction, the definition of Tenant may include more than one individual. This is the case, for example, when two individuals wish to jointly sign a lease with respect to an Object.

"Platform" The digital housing platform of Rentscreen where recipients can post housing offers and the Tenant can respond to them.

Article 3. Applicability

By accessing or using the Platform, you accept these terms and conditions in full and without reservation. You agree that all information you provide on the Platform is accurate and reliable.

Your access to and use of the Platform is also subject to your acceptance of Huurscreen's Privacy Policy. This document describes our policies and procedures regarding the collection, use and disclosure of your personal information when you use the Platform.

Article 4. Rejection of warranty

Rentscreen provides the Platform and its content on an "as is," "as available" and "with all defects present" basis. While the content of the Platform has been compiled with the utmost care, no warranty or representation, either express or implied, is made as to the reasonableness, accuracy or completeness of the information published on the Platform or accessed through the Platform.

Huurscreen does not accept any liability for the possible consequences if the Platform is not available (undisturbed) for any reason at any time. The Platform may be temporarily or permanently disabled without prior notice. "Huurscreen" does not guarantee that the Platform is free of viruses or other similar disruptive elements. These exclusions of liability of "Huurscreen" also apply to all auxiliary personnel and third parties engaged by "Huurscreen".

The content found on the Platform, including content on our social media accounts or blogs, does not constitute legal advice and is provided for informational purposes only.

Article 5. Limitation of liability

Although "Huurscreen" takes the utmost care in managing the Platform, the information displayed, transmitted or provided may not be complete or accurate. Huurscreen expressly disclaims any liability for any damage that may result from access to the Platform and the use of the Platform or the information contained on affiliated sites, including information from third-party sites connected or linked to these sites.

The data present on the Platform are intended to provide general information and are not exhaustive or intended as advice. Huurscreen, as well as the boards and employees of Huurscreen, do not accept any liability for the information and/or recommendations published on the Platform or accessed through the Platform. This information and recommendations are subject to change without prior warning. No rights can be derived from the information provided.

Huurscreen is in no way liable for the consequences of activities undertaken on the basis of the Platform, nor for electronic communications through the Platform.

Article 6. Use of the Service by a Renter.

By signing up through Rentscreen, you authorize us to perform necessary checks to identify and review your credit history and anti-fraud measures related to you.

As a tenant, it is not necessary to register an account. You may be asked to submit the necessary information to enable delivery of the service. During this process, you may not provide false information. Communication with Rentscreen will be primarily via email unless otherwise noted.

During the subscription process, you may be asked to log in to Third Party services. The Platform collects in this way only relevant information to complete your registration. Login information (where used) from such Third Party services is promptly deleted from our server.

Any verification process may fail due to uncontrollable circumstances, such as failure of third parties such as DigiD. As a result, we cannot accept responsibility for any failed verification processes or any loss or damage as a result.

In some cases, the Recipient may contact your employer or other contact person to validate your employment.

Article 7. Third Parties

The Platform may contain links to third-party (mobile) applications, websites or features. Huurscreen does not control the web services or other content of these third parties. You expressly acknowledge and agree that Huurscreen is in no way responsible or liable for such third-party services or features, or for any data provided by such third-party services or features. We encourage you to read the terms and privacy policies of these third parties.

At your sole discretion and risk, you may use capabilities of the Platform to connect to third-party services, such as the UWV or the Internal Revenue Service ("Third Parties"), whereupon such sites may integrate with, connect to, or exchange information with your profile on the Platform. By using such Third Parties, you acknowledge and agree to the following: (1) if you use a Third Party to share your information, you consent to the sharing of information from the Third Party with the Platform; (2) the use of a Third Party may result in personally identifiable information that may be disclosed, even if Huurscreen did not provide such information itself; and (3) the use of any Application is your own choice and risk, and you indemnify Huurscreen for Platform-related activities.

Article 8. Automatically generated content

Huurscreen takes no responsibility and assumes no liability for Tenant-generated content posted, stored or uploaded by you or any third party, or for any loss or damage thereto. Huurscreen does not endorse or guarantee the accuracy of any User-Generated Content. Huurscreen has no obligation to accept, display, review or maintain any User-Generated Content.

Article 9. Use of the Service by a Recipient.

Use of the Platform requires you to register an account. You may not create more than one account per person, and you are also prohibited from accessing the accounts of others. Your password and other user authentication information must be kept confidential, and you agree not to disclose your password to any third party. If you notice any breach of security or unauthorized use of your account, you must notify us immediately.

By using the Platform, you agree that the information provided by a Renter will be used solely for the purpose of assessing the suitability of such Renter to rent an Object. You agree that you will not use the information obtained through the Platform for any other purpose or disclose it to any third party.

The use of the Platform depends on the cooperation of the Renter. We cannot guarantee that a Renter will truthfully complete all verification processes. Therefore, Huurscreen cannot be held responsible for a Renter's lack of cooperation.

In addition, you agree that you will not use the Service to distribute any illegal, or otherwise harmful material; you agree that you will not do anything to interfere with other users' access to the Service and that you will not copy any material from the Service without our permission.

By accepting these terms and conditions and continuing to use this Service, you authorize us and our subcontractors and partners to use the information you provide to provide the Service.

Article 10. Payment

Fundamentally, Rent Screen is free; when additional checks are required to screen the Renter, charges may apply. The costs for the checks are indicated in the form of Credits, which can be purchased as a bundle.

Payment shall be made in advance using a preferred payment method specified by the Recipient. By providing Huurscreen with a preferred payment method, you represent that you are authorized to use the payment method you provide and that all payment information you provide is true and accurate.

You must pay all reasonable costs we incur to collect overdue amounts. This includes reasonable legal fees and other costs and fees in the event of non-payment.

Article 11. Cancellation and refunds.

Payments are non-refundable. When you use paid tools and features of the Service, you agree that we will immediately begin providing such paid tools and features. You are not entitled to a cancellation or "cooling off" period, except where a "cooling off" period is required by law.

If we make an error on your bill, you must notify us within ninety (90) days of the first appearance of the error on your bill. We will then promptly investigate the charge. If you do not notify us within that time, you release us from all liability and claims of loss resulting from the error, and we will not be required to correct the error or provide a refund.

Article 12. Termination

Rentscreen is authorized to terminate Recipient's account at any time in its sole discretion if you breach any of your representations, warranties or obligations under these Terms and Conditions.

Termination does not relieve you of any payment obligations incurred prior to termination, or any other obligations under any other agreement not specifically terminated.

Article 13. Intellectual property rights

Huurscreen hereby grants you a non-transferable right of use (license) to use the Platform. The Platform contains content owned or licensed by Huurscreen. All data on the Platform, including text, photographs, illustrations, graphic material, (trade) names, logos, trademarks and service marks, are owned or licensed by Huurscreen and are protected by copyright, trademark and/or other intellectual property rights. The (intellectual) property rights are in no way transferred to (legal) persons accessing the site.

The user of the Platform is responsible for choosing to use the Platform. The use of its content is therefore entirely at the user's own risk. The Platform is intended for the user's own personal use, whereby the user of the Platform is not permitted to reproduce, modify, delete, transmit, distribute, disseminate or make available to third parties for remuneration the content of the Platform without the express, written consent of Huurscreen.
